Terms of Use

These Terms of Use govern your access to and use of KhayaPro, including the mobile app, web app, website, and related services. KhayaPro is operated by Silver Spectrum Solutions (Pty) Ltd (“Silver Spectrum”, “KhayaPro”, “we”, “us”, or “our”). By registering for, accessing, or using the Platform, you agree to these Terms of Use and our Privacy Policy.

KhayaPro is a household and informal worker management platform designed to help South African homeowners, household employers, co-administrators, and workers manage employment-related administration more effectively.
About KhayaPro
KhayaPro provides practical tools for domestic and household employment management, which may include:
  • Owner, co-owner and worker profiles
  • Attendance and clock-in / clock-out records
  • Leave requests and leave tracking
  • Payslip generation and payment records
  • Employment contracts, house rules and document storage
  • Shopping lists, reminders, tasks and household communication tools
  • First-aid guidance and general information resources
  • Subscription, billing and payment features
KhayaPro is intended to support administration and record-keeping. It does not replace professional legal, labour, tax, payroll, accounting, medical, financial or compliance advice.
Acceptance of These Terms
By registering for or using KhayaPro, you confirm that you have read, understood and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use the Platform.

If you use KhayaPro on behalf of a household, business, employer, trust or other person, you confirm that you are authorised to accept these Terms on their behalf.
Eligibility
  • You must be at least 18 years old to register as an owner, employer, account holder or co-owner.
  • Users are encouraged to ensure their household employment arrangements are lawful under South African law.
  • Worker accounts may be created by an authorised owner or co-owner, or by such other lawful process as the Platform may allow.
  • You may not use KhayaPro if prohibited by applicable law or if we have previously suspended your account for serious misuse.
5. Account Registration and Responsibilities
You are responsible for your account and all activity under it. You agree to:
  • Provide accurate, truthful and up-to-date information
  • Keep your login credentials, PINs and passwords confidential
  • Use strong passwords and reasonable security practices
  • Ensure co-owners, co-admins and invited users use the Platform lawfully
  • Notify us immediately if you suspect unauthorised access
  • Not share access with unauthorised persons
  • Ensure information uploaded about workers, next of kin, or emergency contacts is lawful, relevant and accurate
6. Homeowner, Co-Owner and Worker Roles
KhayaPro is built around role-based access. Owners and co-owners may have broader access to household employment records. Workers may have access to their own profile, attendance, leave, payslip, task or other relevant information, depending on the functionality enabled.

Owners are responsible for managing access permissions carefully and removing access where a person no longer requires it.
7. Employer and Labour Law Responsibilities
KhayaPro provides practical tools to help homeowners manage household employment records more responsibly. Depending on the worker's circumstances, certain legal obligations may apply, including:
  • The Basic Conditions of Employment Act
  • The National Minimum Wage Act and applicable minimum wage determinations
  • UIF and other employment-related obligations
  • Lawful working hours, overtime, leave, notice periods and record-keeping
  • Issuing accurate payslips and maintaining employment records
Any calculators, templates, payslips, guides, or suggested wording in KhayaPro are provided as support tools only. You remain responsible for checking that records and calculations are correct. Homeowners remain responsible for checking which legal obligations apply and should seek professional advice where unsure.
8. Worker Data, Consent and POPIA Responsibilities
Where you upload or capture personal information about a worker, co-owner, next of kin, emergency contact, child, or any other person, you confirm that you have a lawful basis to do so. As a household employer capturing another person's information, you agree to:
  • Inform the worker that their information is being captured in KhayaPro
  • Capture only information that is necessary and relevant for the employment purpose
  • Obtain consent where required, especially for sensitive or location-based features
  • Keep information accurate and up to date
  • Use the information only for lawful and legitimate purposes
  • Respect workers' rights to access, correction, objection or deletion where applicable
  • Handle personal information fairly, securely and responsibly
KhayaPro facilitates storage and management of information but does not own worker data and does not sell it. Our processing of personal information is explained in the KhayaPro Privacy Policy.
9. Attendance, GPS and Location-Based Features
If attendance, clock-in / clock-out, GPS or location-based features are enabled, the Platform may record timestamps, location coordinates, device confirmations and related activity records. These features are intended for attendance, verification, and household employment administration purposes.

Owners and co-owners must use location-based features lawfully, transparently and proportionately. Workers should be told clearly when location information is being captured and why.
10. Documents, Templates and User Content
The Platform may allow users to generate, upload, store or share documents and content such as contracts, payslips, house rules, leave forms, notes, images, and household employment materials. You retain responsibility for the content you upload or generate. You must not upload unlawful, offensive, discriminatory, defamatory, threatening, fraudulent, or harmful content.
11. Acceptable Use
You agree not to use KhayaPro to:
  • Provide false, misleading, fraudulent or unlawful information
  • Violate labour law, privacy law, consumer law or any other applicable law
  • Discriminate, harass, threaten, exploit or abuse any person
  • Store or transmit unlawful, offensive, harmful or malicious content
  • Attempt to access another person's account or data without authority
  • Circumvent, disable or interfere with security or access controls
  • Reverse-engineer, copy, scrape, modify, resell or redistribute the Platform
  • Introduce malware, viruses, automated bots or harmful code
  • Use the Platform in a manner that disrupts or damages the service, infrastructure or other users
  • Misrepresent your identity, authority or relationship with any worker, household or employer
12. Subscriptions, Fees and Billing
Certain KhayaPro features require a paid subscription. Fees, billing cycles, included features and payment options will be communicated through the Platform. Prices are in South African Rand and may be inclusive or exclusive of VAT depending on how displayed. We may change fees from time to time with reasonable notice of material pricing changes.

You are responsible for ensuring your billing information is accurate and payments are made on time. Failure to pay may result in suspension, downgrade or termination of access to paid features.
13. Payment Processing
Where subscription or payment features are enabled, payments may be processed through PayFast or another third-party payment provider. KhayaPro does not store card details. Payment transactions may be subject to the terms, security controls and privacy notices of the payment provider.

We may receive limited payment and transaction information, such as transaction references, payment status, subscription status and billing metadata, to administer your account.
14. Cancellations, Refunds and Cooling-Off
You may cancel your subscription in the manner provided in the Platform or by contacting us. Cancellation will usually stop future billing but may not automatically result in a refund for past payments or the current billing period, unless required by law or expressly agreed by us.

Where the Consumer Protection Act or other applicable law grants a cooling-off, refund, or cancellation right, we will apply the relevant legal requirement.
15. Platform Availability, Updates and Changes
We aim to keep KhayaPro available and reliable but do not guarantee uninterrupted, error-free or always-available service. The Platform may be affected by maintenance, updates, outages, internet connectivity, mobile networks, third-party services, security incidents, or factors outside our reasonable control.

We may improve, modify, suspend, remove or add features from time to time.
16. Third-Party Services and Links
KhayaPro may integrate with or link to third-party services, including payment gateways, cloud hosting providers, authentication providers, app stores, analytics tools, support tools, partner offers, referral forms or external information resources. Third-party services are governed by their own terms and privacy policies. We are not responsible for their content, availability, accuracy, or security practices.
17. First-Aid, Legal, Labour and General Information
KhayaPro may include general guidance, checklists, templates or information sections, including first-aid, employer responsibilities, worker rights, minimum wage, leave, contracts, payslips or household-management guidance.

This content is provided for general information and convenience only. It is not medical advice, legal advice, labour advice, tax advice or financial advice. In an emergency, contact the relevant emergency services. For legal, labour, tax, payroll or medical matters, consult an appropriate professional or official source.
18. Intellectual Property
KhayaPro, including its name, logo, designs, user interface, software, workflows, templates, databases, documentation, content, branding and related intellectual property, is owned by or licensed to Silver Spectrum Solutions (Pty) Ltd.

You are granted a limited, non-exclusive, non-transferable and revocable right to use the Platform for its intended purpose. You may not copy, modify, reverse-engineer, reproduce, sell, license, distribute, or commercially exploit any part of KhayaPro without our prior written permission.
19. Privacy
Your use of the Platform is also governed by the KhayaPro Privacy Policy, which explains how personal information is collected, used, stored, shared and protected. By using KhayaPro, you acknowledge that you have read and understood the Privacy Policy.
20. Security
We take reasonable technical and organisational steps to protect the Platform and personal information. However, no digital system is completely secure. You agree to use the Platform responsibly, keep credentials confidential, protect your devices, and report suspected security incidents promptly.
21. Disclaimer of Warranties
KhayaPro is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not warrant that the Platform will be uninterrupted, error-free, fully secure, or suitable for every user's specific circumstances.

We do not guarantee that any payslip, calculation, template, reminder, record, report, guide or output will be legally sufficient, complete, accurate or appropriate for every situation. Users must review outputs and obtain professional advice where needed.
22. Limitation of Liability
To the maximum extent permitted by applicable South African law, Silver Spectrum Solutions (Pty) Ltd, its directors, employees, contractors, suppliers and affiliates will not be liable for indirect, incidental, special, punitive or consequential losses arising from or connected to the use of KhayaPro, including loss of profits, loss of data, loss of goodwill, business interruption, employment disputes, or failures caused by third-party services or networks.

Nothing in these Terms excludes liability where the law does not allow exclusion or limitation.
23. Indemnity
You agree to indemnify and hold Silver Spectrum Solutions (Pty) Ltd harmless from claims, losses, damages, liabilities, penalties, costs or expenses arising from your unlawful or improper use of the Platform, information or documents you upload, your breach of these Terms, your breach of labour, privacy, consumer, tax, UIF or other laws, employment disputes between you and a worker or household member, your failure to obtain required consent or authority, or your misuse of another person's personal information.
24. Suspension and Termination
We may suspend, restrict or terminate access to KhayaPro if we reasonably believe that you have breached these Terms, your account is being used unlawfully or fraudulently, there is a security risk, payment is overdue, or we are required to do so by law, a regulator, or a court order.

You may request account deletion or cancellation by contacting us. Certain records may need to be retained where required by law, for dispute resolution, accounting, security, or legitimate business purposes.
25. Electronic Communications and Notices
You agree that we may communicate with you electronically through the Platform, email, SMS, WhatsApp, push notification or other reasonable channels. Electronic communications may include service notices, security alerts, billing messages, policy updates and support communications. You are responsible for keeping your contact details up to date.
26. Changes to These Terms
We may update these Terms of Use from time to time. Where changes are material, we will take reasonable steps to notify users through the Platform, by email or by another appropriate method. Continued use of KhayaPro after updated Terms take effect may amount to acceptance of the updated Terms, subject to applicable law.
27. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms or the use of KhayaPro will be subject to the jurisdiction of the South African courts, unless applicable law requires otherwise.
